Annotated Code of Maryland

(2002 Replacement Volume and 2003 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 16-402(a)(11) through (37) and 16-812(j) through (p),

respectively, of Article - Transportation of the Annotated Code of Maryland be

renumbered to be Sections 16-402(a)(12) through (38) and 16-812(k) through (q),
respectively.

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

Article - Transportation

16-402.

(a) After the conviction of an individual for a violation of Title 2, Subtitle 5, §
2-209, or § 3-211 of the Criminal Law Article, or of the vehicle laws or regulations of
this State or of any local authority, points shall be assessed against the individual as
of the date of violation and as follows:

(10) A VIOLATION OF § 21-1003(J) OF THIS ARTICLE WHILE OPERATING A
COMMERCIAL MOTOR VEHICLE IN ANNE ARUNDEL COUNTY..............................2 POINTS

(11) Any moving violation contributing to an accident...................3 points

16-812.

(J) (1) THE ADMINISTRATION SHALL DISQUALIFY A PERSON FROM DRIVING
A COMMERCIAL MOTOR VEHICLE FOR A PERIOD OF 30 DAYS IF THE PERSON IS:

(I) CHARGED WITH COMMITTING A VIOLATION OF § 21-1003(J) OF
THIS
ARTICLE, WHILE OPERATING A COMMERCIAL MOTOR VEHICLE IN ANNE
ARUNDEL COUNTY, THREE TIMES
WITHIN A 180-DAY PERIOD; AND

(II) CONVICTED OF ALL THREE VIOLATIONS.

(2) THE ADMINISTRATION SHALL DISQUALIFY A PERSON FROM DRIVING
A COMMERCIAL MOTOR VEHICLE FOR A PERIOD OF 130 DAYS
IF THE PERSON:

(I) HAS PREVIOUSLY BEEN DISQUALIFIED FROM DRIVING A
COMMERCIAL MOTOR VEHICLE UNDER PARAGRAPH (1) OF THIS SUBSECTION;

(II) IS SUBSEQUENTLY CHARGED WITH COMMITTING A VIOLATION
OF
§ 21-1003(J) OF THIS ARTICLE, WHILE OPERATING A COMMERCIAL MOTOR
VEHICLE IN ANNE ARUNDEL COUNTY, THREE TIMES WITHIN A 180-DAY PERIOD; AND

(III) IS CONVICTED OF ALL THREE VIOLATIONS.
