Council of the Town of Kensington have until June 1, 2004, to present evidence
satisfactory to the Board of Public Works that a matching fund will be provided. If
satisfactory evidence is presented, the Board shall certify this fact and the amount of
the matching fund to the State Treasurer, and the proceeds of the loan equal to the
amount of the matching fund shall be expended for the purposes provided in this Act.
Any amount of the loan in excess of the amount of the matching fund certified by the
Board of Public Works shall be canceled and be of no further effect.
(6) THE BOARD OF PUBLIC WORKS MUST ENCUMBER OR EXPEND THE
PROCEEDS OF THE LOAN BY THE PROCEEDS OF THE LOAN MUST BE ENCUMBERED
BY THE BOARD OF PUBLIC WORKS OR EXPENDED FOR THE PURPOSES PROVIDED IN
THIS ACT NO LATER THAN JUNE 1, 2005.
(7) (a) Prior to the issuance of the bonds, the Mayor and Town Council of the
Town of Kensington shall grant and convey to the Maryland Historical Trust a
perpetual preservation easement to the extent of its interest:
(i) On the land or such portion of the land acceptable to the Trust;
and
(ii) On the exterior and interior, where appropriate, of the historic
structures.
(b) The easement must be in form and substance acceptable to the Trust
and the extent of the interest to be encumbered must be acceptable to the Trust.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act is an emergency
measure, is necessary for the immediate preservation of the public health or safety,
has been passed by a yea and nay vote supported by three-fifths of all the members
elected to each of the two Houses of the General Assembly, and shall take effect from
the date it is enacted.

AN ACT concerning
Dorchester County - Right Authorization to Harvest Seafood and Engage in
the Seafood Industry
FOR the purpose of authorizing the County Council of Dorchester County to adopt an
ordinance, resolution, or regulation or take other action to protect a person's
right authorize a person to engage in certain activities related to the seafood
industry and to harvest seafood; requiring the County Council to hold a public
hearing and obtain the written consent of the Secretary of Natural Resources
before adopting a certain ordinance, resolution, or regulation; providing that an
ordinance, resolution, or regulation adopted without certain consent is void and
