2004 LAWS OF MARYLAND

(13)   A REQUIREMENT THAT A BID OR PROPOSAL BASED ON A
SOLICITATION WITH AN EXPECTED DEGREE OF MINORITY BUSINESS ENTERPRISE
PARTICIPATION INCLUDE PROOF OF A CERTIFIED MINORITY BUSINESS ENTERPRISE
COMMITMENT
IDENTIFY THE SPECIFIC COMMITMENT OF CERTIFIED MINORITY
BUSINESS ENTERPRISES
AT THE TIME OF SUBMISSION; AND

(14)    other provisions that the Board considers necessary or appropriate to
encourage participation by minority business enterprises and to protect the integrity
of the procurement process.

SECTION 2. AND BE IT FURTHER ENACTED, That the publisher of the
Annotated Code of Maryland, in consultation with and subject to the approval of the
Department of Legislative Services, shall correct, with no further action required by
the General Assembly, cross-references and terminology rendered incorrect by this
Act or by any other Act of the General Assembly of 2004 that affects provisions
enacted by this Act. The publisher shall adequately describe any such correction in an
editor's note following the section affected.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 2004.

(Senate Bill 904)

AN ACT concerning

Procurement - Small Business Procurement Contracts - Reserve Preference

FOR the purpose of establishing a Small Business Reserve Program; designating the
types of procurements in which the Small Business Reserve Program may
participate; requiring certain procurement units to achieve a certain percentage
of small business procurement contracts under the Program; requiring the
Department of General Services to establish certain procedures to assist small
businesses; requiring certain procurement units to report to the Board of Public
Works by a certain date; providing for the application of certain provisions of
this Act; providing that the total dollar value of procurements by certain
procurement units do not include the value of certain contracts to which this Act
does not apply because of a conflict with federal law; defining certain terms;
providing for the termination of this Act; and generally relating to small
business procurement contracts.

BY adding to

Article - State Finance and Procurement

Section 14-501 through 14-505, inclusive, to be under the new subtitle

"Subtitle 5. Small Business Reserve Program"
