(2) The winery special event permit may only be issued for an event
which:

(i) Has as its major purpose an activity other than the sale and
promotion of alcoholic beverages and for which the participation of the winery is a
subordinate activity;

(ii) [Is organized and conducted by a nonprofit organization or
government entity;

(iii)] Is approved by the Department; of Agriculture and the Office of
the Comptroller; and

[(iv)] (III) Is held on a nonlicensed premises or a premises on which a
person may obtain a temporary alcoholic beverages license.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 2004.

Dear Mr. Speaker:

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed House Bill 411 — Health Insurance - Required Reimbursement - Podiatrists.

This bill provides that, if a specified health insurance policy or contract provides for
reimbursement for a service that is within the lawful scope of practice of a licensed
podiatrist, the insured or any other person covered by or entitled to reimbursement
under the health insurance policy or contract is entitled to the same amount of
reimbursement for the service regardless of whether the service is performed by a
physician or a licensed podiatrist.

Senate Bill 437, which was passed by the General Assembly and signed by me on May
26, 2004, accomplishes the same purpose. Therefore, it is not necessary for me to sign
House Bill 411.
