ROBERT L. EHRLICH, JR., Governor                            S.B. 434

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 434 - State Treasury - Unpresented Checks Fund.

This bill alters the procedures the Treasurer must follow in asking the Comptroller to
credit the amount of specified unpresented checks to the Unpresented Checks Fund.
It alters the procedures for transferring a specified portion of the balance of the Fund
to the General Fund, and removes a prohibition on reissuing checks after a specified
period. It also specifies the procedures to be followed in voiding an unpresented check,
exempting unpresented checks credited to the Fund from specified statutory
provisions.

House Bill 688, which was passed by the General Assembly and signed by me on May
11, 2004, accomplishes the same purpose. Therefore, it is not necessary for me to sign
Senate Bill 434.

AN ACT concerning

State Treasury - Unpresented Checks Fund

FOR the purpose of altering the procedures the Treasurer must follow in asking the
Comptroller to credit the amount of certain unpresented checks to the
Unpresented Checks Fund; altering the procedures for transferring a certain
portion of the balance of the Fund to the General Fund; removing a prohibition
on reissuing checks after a certain period; specifying the procedures to be
followed in voiding an unpresented check; exempting unpresented checks
credited to the Fund from certain statutory provisions; and generally relating to
the Unpresented Checks Fund.

BY repealing and reenacting, with amendments,

Section 7-230

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - State Finance and Procurement

7-230.

(a)     In this section, "Fund" means the Unpresented Checks Fund.

(b)     There is an Unpresented Checks Fund.

(c)     At the end of each fiscal year, the Treasurer shall:
