(IX)    THE TRAILER OR SEMITRAILER HAS A GROSS WEIGHT RATING,
REGISTERED WEIGHT, OR GROSS WEIGHT, WHICHEVER IS GREATER, THAT IS NO
MORE THAN ONE AND ONE-HALF TIMES THE GROSS WEIGHT RATING OR
REGISTERED WEIGHT, WHICHEVER IS LESS, OF THE TOWING VEHICLE; AND

(X)     FOR VEHICLES USED FOR COMMERCIAL PURPOSES, THE
TRAILER OR SEMITRAILER IS USED ONLY IN INTRASTATE COMMERCE.

SECTION 2. AND BE IT FURTHER ENACTED, That the Secretary of
Transportation shall adopt regulations, to be effective beginning October 1, 2004,
authorizing the use of surge brakes on trailers and semitrailers as authorized in this
Act.

SECTION 3. AND BE IT FURTHER ENACTED, That Section 1 of this Act shall
take effect October 1, 2004.

SECTION 4. AND BE IT FURTHER ENACTED, That, except as provided in
Section 3 of this Act, this Act shall take effect June 1, 2004.

Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 400 - Streamlined Sales and Use Tax Agreement.

This bill adopts the Streamlined Sales and Use Tax Agreement as adopted by the
Streamlined Sales and Use Tax Project on November 12, 2002, contingent on the
enactment of specified legislation by the U.S. Congress and requires the Comptroller
to prepare and submit proposed regulations and draft legislation implementing
changes to the State's laws, regulations, or policies needed to bring the State into
compliance with the Agreement and other changes recommended by the Comptroller.

House Bill 694, which was passed by the General Assembly and signed by me on May
26, 2004, accomplishes the same purpose. Therefore, it is not necessary for me to sign
Senate Bill 400.
