(v) Providing information, explanation, or recommendations to
patients and health care practitioners about the safe and effective use of prescription
or nonprescription drugs or devices; [or]
(vi) Identifying and appraising problems concerning the use or
monitoring of therapy with drugs or devices; OR
(VII) ADMINISTERING MEDICATION TO AN INDIVIDUAL IN
ACCORDANCE WITH REGULATIONS ADOPTED BY THE BOARD AN INFLUENZA
VACCINATION IN ACCORDANCE WITH § 12-508 OF THIS TITLE-
SECTION 3. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:
Article - Health Occupations
12-508.
(A) A PHARMACIST MAY ADMINISTER AN INFLUENZA VACCINATION TO AN
INDIVIDUAL, IN ACCORDANCE WITH REGULATIONS ADOPTED UNDER SUBSECTION
(C) OF THIS SECTION.
(B) THE BOARD SHALL SET REASONABLE FEES FOR THE ADMINISTRATION OF
AN INFLUENZA VACCINATION IN ACCORDANCE WITH SUBSECTION (A) OF THIS
SECTION THAT ACCOUNT FOR THE COST OF THE VACCINATION AND A REASONABLE
CHARGE FOR THE ADMINISTRATION OF THE VACCINATION.
(C) THE BOARD, TOGETHER WITH THE BOARD OF PHYSICIANS AND THE
BOARD OF NURSING, SHALL JOINTLY DEVELOP AND ADOPT REGULATIONS TO
PROVIDE FOR PATIENT SAFETY AND TO IMPLEMENT THIS SECTION.
SECTION 3. AND BE IT FURTHER ENACTED, That the State Board of
Pharmacy, in consultation with the State Board of Physicians and the State Board of
Nursing, shall adopt regulations necessary to implement this Act.
SECTION 4. AND BE IT FURTHER ENACTED, That Section 2 of this Act shall
take effect on the taking effect of the termination provision specified in Section 5 of
Chapter 249 of the Acts of the General Assembly of 2002. If that termination provision
takes effect, Section 1 of this Act shall be abrogated and of no further force and effect.
This Act may not be interpreted to have any effect on that termination provision.
SECTION 5. AND BE IT FURTHER ENACTED, That, subject to the provisions
of Section 4 of this Act, this Act shall take effect October 1, 2004.
