FOR the purpose of altering the authority of the State Board of Dental Examiners to
adopt certain regulations governing the administration of a certain type relating
to a certain form of sedation; prohibiting the Board from issuing a permit to
certain facilities under certain circumstances; prohibiting the Board from
issuing a permit to certain dentists under certain circumstances requiring
certain facilities or certain dentists to obtain certain permits under certain
circumstances; requiring the Board to develop and draft certain regulations only
after having convened and consulted with a certain committee consisting of
certain representatives; requiring the Board to hold a certain number of public
hearings regarding the proposed adoption of certain regulations; requiring the
publication of the date of certain hearings in the Maryland Register; and
generally relating to the regulation of sedation and the issuance of permits by
the State Board of Dental Examiners.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Health Occupations
4-205.
(a) In addition to the powers set forth elsewhere in this title, the Board may:
(1) Adopt regulations governing:
(i) The administration of general anesthesia by a licensed dentist;
(ii) The administration of [parenteral] CONSCIOUS sedation by a
licensed dentist;
(iii) The use of a dental assistant by a licensed dentist in performing
intraoral procedures;
(iv) [The] SUBJECT TO THE PROVISIONS OF SUBSECTION (B) OF
THIS SECTION, THE issuance of a permit to a facility not otherwise regulated where a
dentist administers or has general anesthesia or [parenteral] CONSCIOUS sedation
administered;
(v) [The] SUBJECT TO THE PROVISIONS OF SUBSECTION (C) (B) OF
THIS SECTION, THE issuance of a permit to a dentist who administers or has general
anesthesia or [parenteral] CONSCIOUS sedation administered;
(vi) Reasonable requirements for the training and evaluation of a
dentist before the dentist may administer general anesthesia or [parenteral]
CONSCIOUS sedation OTHER THAN NITROUS OXIDE ADMINISTERED ALONE AND NOT
IN CONJUNCTION WITH:
