(d)     (1) The Maryland Energy Administration shall receive administrative
and fiscal support from the Fund for studies relating to the conservation or
production of electric energy.

(2) Fiscal support to the Maryland Energy Administration from the
Fund may not exceed $250,000 in any fiscal year.

(e)     The Legislative Auditor shall conduct post audits of a fiscal and
compliance nature of the Fund and of the appropriations and expenditures made for
the purposes of this subtitle. The cost of the fiscal portion of the post audit
examinations shall be an operating cost of the Fund.

[There is a State Fisheries Management and Protection Fund in the
Department. Any money received from any fish and fisheries license, stamp, permit,
or application fee as provided in this title, unless otherwise provided shall be credited
to the Fund and used only for the scientific investigation, protection, propagation, and
management of nontidal finfish.]

(A)     IN THIS SECTION, "FUND" MEANS THE STATE FISHERIES MANAGEMENT
AND PROTECTION FUND.

(B)     THERE IS A STATE FISHERIES MANAGEMENT AND PROTECTION FUND IN
THE DEPARTMENT.

(C)     THE PURPOSE OF THE FUND IS TO FINANCE THE SCIENTIFIC
INVESTIGATION, PROTECTION, PROPAGATION, AND MANAGEMENT OF NONTIDAL
FINFISH.

(D)     THE DEPARTMENT SHALL ADMINISTER THE FUND.

(E)     (1) THE FUND IS A SPECIAL, NONLAPSING FUND THAT IS NOT SUBJECT
TO § 7-302 OF THE STATE FINANCE AND PROCUREMENT ARTICLE.

(2) THE TREASURER SHALL HOLD THE FUND SEPARATELY AND THE
COMPTROLLER SHALL ACCOUNT FOR THE FUND.

(F)     THE FUND CONSISTS OF:

(1)      ANY MONEY RECEIVED FOR A FISH AND FISHERIES LICENSE, STAMP,
PERMIT, OR APPLICATION FEE UNDER THIS TITLE, UNLESS OTHERWISE PROVIDED;
AND

(2)      ANY INVESTMENT EARNINGS OF THE FUND.

(G)     THE FUND MAY BE USED ONLY FOR THE SCIENTIFIC INVESTIGATION,
PROTECTION, PROPAGATION, AND MANAGEMENT OF NONTIDAL FINFISH.

(H) (1) THE TREASURER SHALL INVEST THE MONEY OF THE FUND IN THE
SAME MANNER AS OTHER STATE MONEY MAY BE INVESTED.
