(g) If after due notice the individual against whom the action is contemplated
fails or refuses to appear, nevertheless the Board may hear and determine the matter.

13-407.

(A)     A person who violates any provision of this title is guilty of a misdemeanor
and on conviction is subject to a fine not exceeding [$1,000] $5,000 OR
IMPRISONMENT NOT EXCEEDING 3 YEARS OR BOTH.

(B)     (1) ANY PERSON WHO VIOLATES § 13-401 OF THIS SUBTITLE IS SUBJECT
TO A CIVIL FINE OF NOT MORE THAN $50,000 TO BE ASSESSED BY THE BOARD.

(2) THE BOARD SHALL PAY ANY PENALTY COLLECTED UNDER THIS
SUBSECTION INTO THE STATE BOARD OF PHYSICAL THERAPY EXAMINERS FUND.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2004.

AN ACT concerning

Property Tax Credit - High Performance Buildings

FOR the purpose of authorizing the governing body of a county or municipal
corporation to grant, by law, a property tax credit against the county or
municipal corporation property tax imposed on certain high performance
buildings; authorizing the county or municipal corporation to provide, by law, for
the amount, duration, and application of the property tax credit and any other
provision necessary to carry out this Act; providing for the application of this
Act; and generally relating to a property tax credit for a high performance
building.
