Ch. 495                                    2004 LAWS OF MARYLAND

as enacted under Section 1 of this Act, may not be applied or interpreted to have any
effect on or application to any lease or other landlord-tenant contract in effect before
the effective date of this Act.

SECTION 3. AND BE IT FURTHER ENACTED, That if any provision of this
Act or the application thereof to any person or circumstance is held invalid for any
reason in a court of competent jurisdiction, the invalidity does not affect other
provisions or any other application of this Act which can be given effect without the
invalid provision or application, and for this purpose the provisions of this Act are
declared severable.

SECTION 2. 4. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 2004.

AN ACT concerning

State Board of Plumbing - Disciplinary Actions

FOR the purpose of authorizing the State Board of Plumbing to deny a license to a
person or take certain disciplinary action against an applicant or a licensee
under the laws relating to the licensure and regulation of plumbers for a
violation of certain laws or regulations relating to plumbing services; and
generally relating to the licensure and regulation of plumbers.

BY repealing and reenacting, with amendments,

Section 12-312

Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Business Occupations and Professions

12-312.

(a) (1) Subject to the hearing provisions of § 12-313 of this subtitle, the
Board may deny a license to any applicant, reprimand any licensee, or suspend or
revoke a license if the applicant or licensee:

(i) fraudulently or deceptively obtains or attempts to obtain a
license for the applicant or licensee or for another;
