(Senate Bill 164)

AN ACT concerning

Acting Attorney General

FOR the purpose of providing for a certain person to serve as acting Attorney General
under certain circumstances; establishing the powers and duties of the acting
Attorney General; setting certain time periods during which the acting Attorney
General would serve; providing for a certain notice; providing that a certain
court has exclusive original jurisdiction over certain issues on petition from
certain persons; authorizing a certain court to pass certain orders; requiring a
certain proceeding to take precedence and be expedited under certain
circumstances; and generally relating to procedures for an acting Attorney
General.

Section 6-110

Annotated Code of Maryland

(1999 Replacement Volume and 2003 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - State Government

6-110.

(A)  THE SENIOR DEPUTY ATTORNEY GENERAL SHALL SERVE AS ACTING
ATTORNEY GENERAL IF THE ATTORNEY GENERAL TEMPORARILY IS UNABLE OR
UNAVAILABLE TO CARRY OUT THE DUTIES OF OFFICE.

(B)  IF THE ATTORNEY GENERAL GIVES THE SENIOR DEPUTY ATTORNEY
GENERAL WRITTEN NOTICE OF A TEMPORARY INABILITY OR UNAVAILABILITY, THE
ACTING ATTORNEY GENERAL SHALL SERVE:

(1) ON AND AFTER THE DATE THAT THE ATTORNEY GENERAL SETS IN
THE NOTICE; AND
