(A) Maryland Agricultural Land Preservation Program. Contingent
upon the enactment of legislation reducing the amount of
property transfer tax allocated to the Agricultural Land
Preservation Program, provide funds for the purchase of
conservation easements on agricultural land. The funds
appropriated for this purpose shall be administered in
accordance with Title 2, Subtitle 5 of the Agricultural Article
Provided, however, that if Section 5-9A-09 of the Natural
Resources Article is not repealed, $5,000,000 of this
appropriation shall be transferred to the Rural Legacy program
