AN ACT concerning
Public Schools - Centers for Disease Control and Prevention Youth Risk
Behavior Surveillance System
FOR the purpose of requiring the State Board Department of Education to establish
procedures for the administration of the Centers for Disease Control and
Prevention Youth Risk Behavior Surveillance System survey; authorizing the
State Board Department to omit certain sections of the survey questions under
certain circumstances; requiring the Department to require a local school
system to obtain certain parental consent; establishing certain requirements for
a certain parental consent form; and generally relating to the administration of
the Centers for Disease Control and Prevention Youth Risk Behavior
Surveillance System survey.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

7-420.
(A) THE STATE BOARD DEPARTMENT SHALL ESTABLISH PROCEDURES FOR
THE ADMINISTRATION OF THE CENTERS FOR DISEASE CONTROL AND PREVENTION
YOUTH RISK BEHAVIOR SURVEILLANCE SYSTEM SURVEY.
(B) THE STATE BOARD DEPARTMENT MAY OMIT A SECTION OF THE SURVEY IF
THE STATE BOARD CONSIDERS THE CONTENT WITHIN THAT SECTION AS
INAPPROPRIATE UP TO A MAXIMUM OF ONE-THIRD OF THE SURVEY QUESTIONS IF
THE DEPARTMENT CONSIDERS THE CONTENT OF THE QUESTIONS INAPPROPRIATE.
(C) (1) THE DEPARTMENT SHALL REQUIRE A LOCAL SCHOOL SYSTEM TO
OBTAIN PARENTAL CONSENT USING A PARENTAL CONSENT FORM BEFORE
ADMINISTERING THE SURVEY.
(2) THE PARENTAL CONSENT FORM SHALL INCLUDE A STATEMENT
THAT EXPLAINS HOW A PARENT CAN OBTAIN SAMPLE QUESTIONS A COPY OF THE
SURVEY QUESTIONS THAT WILL BE ADMINISTERED AND MORE INFORMATION
REGARDING THE SURVEY, EXCLUDING THE MAILING ADDRESS, TELEPHONE NUMBER
AND WEBSITE ADDRESS OF THE CENTERS FOR DISEASE CONTROL AND PREVENTION.
