(II) DOCUMENTATION THAT THE VETERAN GRADUATED FROM A
PUBLIC OR PRIVATE SECONDARY SCHOOL IN THIS STATE OR RECEIVED THE
EQUIVALENT OF A HIGH SCHOOL DIPLOMA IN THIS STATE.

(C)     NOTWITHSTANDING ANY OTHER PROVISION OF THIS ARTICLE,
BEGINNING WITH THE 2004 FALL SEMESTER, A SPOUSE OR FINANCIALLY
DEPENDENT CHILD OF AN ACTIVE DUTY MEMBER WHO IS ENROLLED AT AN
ENROLLS AS AN ENTERING STUDENT IN A PUBLIC INSTITUTION OF HIGHER
EDUCATION AND IS EXEMPT FROM PAYING NONRESIDENT TUITION UNDER
SUBSECTION (B) OF THIS SECTION SHALL CONTINUE TO BE EXEMPT FROM PAYING
NONRESIDENT TUITION IF:

(1)      THE ACTIVE DUTY MEMBER NO LONGER MEETS THE REQUIREMENTS
OF SUBSECTION (B)(1) OF THIS SECTION; AND

(2)      THE SPOUSE OR FINANCIALLY DEPENDENT CHILD REMAINS
CONTINUOUSLY ENROLLED AT THE PUBLIC INSTITUTION OF HIGHER EDUCATION.

(D)     THE COMMISSION SHALL ADOPT REGULATIONS IN ACCORDANCE WITH
TITLE 10, SUBTITLE 1 OF THE STATE GOVERNMENT ARTICLE TO IMPLEMENT THE
PROVISIONS OF THIS SECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1, 2004.

AN ACT concerning

Education - Public School Construction - Modular Construction

FOR the purpose of requiring the Board of Public Works to include modular
construction as an approved public school construction or capital cost; requiring
the Board of Public Works to adopt certain regulations; and generally relating to
public school construction and modular construction.

BY repealing and reenacting, with amendments,

Section 5-301(a)
Annotated Code of Maryland
(2001 Replacement Volume and 2003 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
