(B) PARTICIPATION IN THE SPECIAL PAY PLAN IS MANDATORY FOR ANY
ELIGIBLE EMPLOYEE.

33-302.

(A)     PARTICIPATING EMPLOYEE CONTRIBUTIONS MADE CONTRIBUTIONS TO
THE SPECIAL PAY PLAN SHALL BE MADE BY THE COMPTROLLER SECRETARY OR THE
SECRETARY'S DESIGNEE AT NO LATER THAN THE TIME THE PARTICIPATING
EMPLOYEE TERMINATES STATE EMPLOYMENT.

(B)     CONTRIBUTIONS MADE BY THE COMPTROLLER SECRETARY OR THE
SECRETARY'S DESIGNEE ON BEHALF OF THE PARTICIPATING EMPLOYEE UNDER
SUBSECTION (A) OF THIS SECTION INCLUDE:

(1)      COMPENSATION FOR THE PARTICIPATING EMPLOYEE'S UNUSED
ANNUAL LEAVE UNDER § 9-305 OF THIS ARTICLE; AND

(2)      ANY OTHER COMPENSATION APPROVED BY THE SECRETARY OR THE
SECRETARY'S DESIGNEE.

(C)     THE COMPTROLLER AND THE SECRETARY OR THE SECRETARY'S
DESIGNEE SHALL ADOPT REGULATIONS THAT ARE NECESSARY TO CARRY OUT THIS
SECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That, if the Secretary
delegates the Secretary's duties under this Act to any other agency or unit of State
government, the Secretary shall notify the Senate Budget and Taxation Committee
and the House Appropriations Committee in writing within 30 calendar days.

SECTION 2. 3. AND BE IT FURTHER ENACTED, That this Act shall take
effect June 1, 2004 July 1, 2005.

AN ACT concerning

Mental Hygiene Administration Community-Based Services FundScope

FOR the purpose of altering the uses of the Waiting List Equity Fund; clarifying the
purpose of the Community-Based Services Fund in the Mental Hygiene
Administration; requiring that certain Mental Hygiene Administration property
be sold or leased under certain circumstances; requiring the funds from the sale
or lease of certain property to be used in a certain manner; repealing a certain
method for calculating the funding for the Fund;
requiring the Mental Hygiene
Administration to develop a plan to spend certain funds in consultation with
certain groups; providing for the application of this Act; requiring the
Department of Health and Mental Hygiene and certain groups to report to certain
