PARRIS N. GLENDENING, Governor Ch. 26
(II) VIOLATE ANY OTHER PROVISION OF THIS PART. (2) A PERSON WHO VIOLATES THIS SUBSECTION IS GUILTY OF A
MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING $500
FOR EACH VIOLATION. (B) WRONGFUL RECEIPT OF PROCEEDS. (1) A PERSON MAY NOT RECEIVE ANY OF THE PROCEEDS OF BINGO
CONDUCTED UNDER THIS PART EXCEPT FOR THE PURPOSES PROVIDED IN THIS
PART. (2) A PERSON WHO VIOLATES THIS SUBSECTION IS GUILTY OF A
MISDEMEANOR AND ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT
EXCEEDING 90 DAYS OR A FINE NOT EXCEEDING $500 OR BOTH. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 251A(1). In subsections (a)(1) and (b)(1) of this section, the former references to any
"portion" of the proceeds are deleted as surplusage. In subsection (a)(1) of this section, the former reference to "rules" is deleted
for consistency within this article. See General Revisor's Note to article. Also in subsection (a)(1) of this section, the former reference to "in any
manner" violating any other provision of this part is deleted as surplusage. In subsection (a)(2) of this section, the reference to each "violation" is
substituted for the former reference to each "offense" for consistency
within this article. See General Revisor's Note to article. In subsection (b)(1) of this section, the reference to bingo "conducted under
this part" is substituted for the former reference to "any such" bingo for
clarity. In subsection (b)(2) of this section, the reference to imprisonment "not
exceeding" 90 days is substituted for the former reference to imprisonment
"for" 90 days to conform to the apparent legislative intent, expressed in the
former provision that "such ... imprisonment [be] in the discretion of the
court", to establish a maximum, and not a mandatory minimum, term of
imprisonment. Also in subsection (b)(2) of this section, the former phrase "such fine and
imprisonment in the discretion of the court" is deleted as implicit in the
establishment of maximum penalties. Defined term: "Person" § 1-101
