(1) A PERSON WHO IS NOT A LEGAL RESIDENT OF FREDERICK COUNTY
MAY NOT CONDUCT BINGO.
(2) NOTWITHSTANDING PARAGRAPH (1) OF THIS SUBSECTION, EACH
YEAR THE FREDERICK COUNTY AGRICULTURAL ASSOCIATION MAY SELL OR LEASE A
RIGHT OR CONCESSION TO ANY PERSON TO CONDUCT BINGO AT THE FREDERICK
COUNTY FAIR
(D) APPLICATION.
(1) TO QUALIFY FOR A BINGO PERMIT, A PERSON SHALL MEET THE
REQUIREMENTS SET BY THE COUNTY COMMISSIONERS.
(2) THE COUNTY COMMISSIONERS MAY REQUIRE AN APPLICANT FOR A
BINGO PERMIT TO PAY A PERMIT FEE SET BY THE COUNTY COMMISSIONERS.
(E) PRIZE LIMITATIONS.
A PERSON WHO CONDUCTS BINGO MAY NOT OFFER OR AWARD:
(1) A PRIZE OR AWARD WITH A FAIR MARKET VALUE EXCEEDING $5,000;
OR
(2) A MONEY PRIZE EXCEEDING $5,000.
(F) REGULATIONS.
THE COUNTY COMMISSIONERS MAY ADOPT REGULATIONS TO CARRY OUT THIS
SECTION.
REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 249.
In subsections (a) and (d) of this section, the references to a "bingo" permit
are added for clarity.
In subsection (a) of this section, the reference to "conduct[ing]" bingo is
substituted for the former reference to "operat[ing]" bingo for consistency
with other provisions of this subtitle. Similarly, in subsection (b) of this
section, the former reference to "operat[ing]" bingo is deleted as included in
the reference to "conduct[ing]" bingo.
In the introductory language of subsection (b) of this section, the phrase "if
a legal resident of the county," is added for clarity and consistency with
subsection (c) of this section.
In subsection (b)(9) of this section, the former reference to "corporations" is
deleted in light of the reference to an "organization".
In subsection (c) of this section, the former phrase "regardless of the
residence of the purchaser or lessee" is deleted as surplusage.
Also in subsection (c) of this section, the former reference to a
"copartnership, firm, group, corporation or organization" is deleted as
