REVISOR'S NOTE: Subsection (a) of this section is new language added to
avoid repetition of the phrases "drug, medicine, or a medicinal or chemical
preparation" and "make, mix, manufacture, or compound". Subsections (b) and (c) of this section are new language derived without
substantive change from former Art. 27, § 230. In subsection (b) of this section, the reference to "in any manner" is
substituted for the former reference to "in part or in whole" for consistency
within this section. Also in subsection (b) of this section, the former redundant references to
"grain" and "wood" alcohol are deleted as implicit in the references to
"ethyl" and "methyl" alcohol, respectively. In subsection (b)(2) of this section, the references to the "preparer" of a
drug are substituted for the former references to the "person ... who ...
make[s], mix[es], manufacture[s], [or] compound[s]" a drug for clarity. In subsection (c) of this section, the former reference to "in the discretion of
the court" is deleted as implicit in the establishment of maximum and
minimum penalties. The Criminal Law Article Review Committee notes, for the consideration
of the General Assembly, that subsection (b) of this section does not
prohibit the use of the poison methyl alcohol in a drug unless ethyl alcohol
is usually used to prepare the drug. Defined term: "Person" § 1-101
8-803. UNAUTHORIZED CARRIER TRANSFER TICKET. (A) PROHIBITED. (1) A PERSON MAY, NOT INTENTIONALLY ISSUE, SELL, OR GIVE TO AN
UNAUTHORIZED PERSON A TICKET OR INSTRUMENT FOR THE TRANSFER FROM A
CONVEYANCE ON ONE PASSENGER LINE OR ROUTE TO A CONVEYANCE ON ANOTHER
LINE OR ROUTE OF THE SAME OR A DIFFERENT CARRIER (2) UNLESS AUTHORIZED TO DO SO, A PERSON MAY NOT
INTENTIONALLY RECEIVE A TICKET OR INSTRUMENT FOR THE TRANSFER FROM A
CONVEYANCE ON ONE PASSENGER LINE OR ROUTE TO A CONVEYANCE ON ANOTHER
LINE OR ROUTE OF THE SAME OR A DIFFERENT CARRIER (B) PENALTY. A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A MISDEMEANOR AND
ON CONVICTION IS SUBJECT TO:
(1) FOR THE FIRST VIOLATION, A FINE NOT LESS THAN $10 AND NOT
EXCEEDING $100; AND
