(II) IS NOT BASED ON A CLAIM THAT OCCURRED MORE THAN 3
YEARS BEFORE THE ANNIVERSARY DATE OF THE POLICY ON WHICH THE PROPOSED
CANCELLATION WOULD TAKE EFFECT; AND
(III) IS OTHERWISE IN ACCORDANCE WITH THIS SUBTITLE. [(3)](4) [Paragraphs (1) and (2) of this subsection do] THIS
SUBSECTION DOES not apply to a claim involving conviction of the insured or
applicant for fraud or arson.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October July October 1, 2002.

Annapolis MD 21401 Dear Mr. Speaker: . In accordance with Article II, Section 17 of the Maryland' Constitution, I have today
vetoed House Bill 1287 - Employees' Pension System - Participating Governmental
Units - Contributory Pension Benefit. This bill provides participating governmental units that participate in the State
Retirement and Pension System with an additional window of opportunity to transfer
their employees from the pre-1998 Employees' Pension System to the enhanced,
contributory Employees' Pension System benefit structure. This window would
extend from the effective date of the bill to December 31, 2002. Senate Bill 868, which was passed by the General Assembly and signed by me,
accomplishes the same purpose. Therefore, it is not necessary for me to sign House

units who are members of the Employees' Pension System to become subject to a
certain contributory pension benefit that alters the benefits those members
receive and requires a certain member contribution; authorizing the purchase of
service credit under certain circumstances; requiring certain participating
