(3) "AGRICULTURAL FARM PRODUCT" HAS THE MEANING STATED IN §
10-601 OF THIS TITLE.
(B) A PERSON MAY NOT WILLFULLY OR MALICIOUSLY DAMAGE OR DESTROY
AN AGRICULTURAL OPERATION OR PRODUCT RESEARCH OPERATION OR FARM
PRODUCT OF ANOTHER PERSON THAT IS BEING USED FOR TESTING OR RESEARCH BY
AN AGRICULTURAL RESEARCH OPERATION.
(C) A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A FELONY
MISDEMEANOR AND ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT
EXCEEDING 1 YEAR 3 YEARS OR A FINE NOT EXCEEDING $5,000 OR BOTH.
(D) IN ADDITION TO ANY OTHER FINES OR PENALTIES PROVIDED FOR A
VIOLATION OF THIS SECTION, A PERSON CONVICTED OF THE UNLAWFUL
DESTRUCTION OF AN AGRICULTURAL OPERATION OR PRODUCT SHALL BE REQUIRED
TO COMPENSATE THE OWNER OF THE DAMAGED OR DESTROYED AGRICULTURAL
OPERATION OR PRODUCT AT TWICE THE MARKET VALUE OF THE AGRICULTURAL
OPERATION OR PRODUCT DAMAGED OR DESTROYED UNDER THIS SECTION SHALL BE
REQUIRED TO COMPENSATE THE OWNER OR LESSOR OF THE DAMAGED OR
DESTROYED AGRICULTURAL RESEARCH OPERATION OR FARM PRODUCT THE FAIR
MARKET VALUE OF THE AGRICULTURAL RESEARCH OPERATION OR FARM PRODUCT
BEFORE THE DAMAGE OR DESTRUCTION, INCLUDING THE COST OF ANY PRODUCT
PRODUCTION. RESEARCH, TESTING, REPLACEMENT. AND PRODUCT DEVELOPMENT
DIRECTLY RELATED TO THE FARM PRODUCT DAMAGED OR DESTROYED.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2002.

Dear Mr. Speaker:
In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed House Bill 1051 — Environment - Wastewater Infrastructure Improvement —
Study.
This bill requires the Maryland Department of the Environment to: (1) in fiscal 2004,
conduct a comprehensive inflow and infiltration data study on every wastewater
treatment system in the State and determine the magnitude of the inflow and
infiltration problem; (2) in fiscal 2005, contract with the Maryland Environmental
Service to conduct at least three comprehensive in-depth inflow and infiltration
studies at selected systems around the State; and (3) in fiscal 2006, finance a utility
rate study for each locality with a wastewater treatment system in Maryland.
Senate Bill 643, which was passed by the General Assembly and signed by me,
