(a) On or before December 15 of the 2nd year before the evaluation date of a
governmental activity or unit, the Legislative Policy Committee, based on a
preliminary evaluation, may waive as unnecessary the evaluation required under this
section.
(b) Except as otherwise provided in subsection (a) of this section, on or before
the evaluation date for the following governmental activities or units, an evaluation
shall be made of the following governmental activities or units and the statutes and
regulations that relate to the governmental activities or units:
(42) Nursing, State Board of (§ 8-201 of the Health Occupations Article:
July 1, [2002] 2012);
SECTION 2. AND BE IT FURTHER ENACTED, That the Maryland Board of
Nursing shall report to the Senate Education, Health, and Environmental Affairs
Committee and the House Environmental Matters Committee on or before October 1,
2002, in accordance with § 2-1246 of the State Government Article, on the
implementation of the recommendations of the Department of Legislative Services
contained in the sunset evaluation report dated October 31, 2001. This report shall
include an evaluation of the development, implementation, and effectiveness of an
action plan to reduce the backlog in complaints, and a description of the efforts of the
Board to reduce operating costs through enhanced efficiency in the use of technology
and personnel.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1, 2002.

Dear Mr. Speaker:
In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed House Bill 463 - State Board of Examiners of Psychologists - Sunset
Extension.
This bill extends the sunset date for the State Board of Examiners of Psychologists
(SBEP) from July 1, 2003 to July 1, 2013 and requires another sunset evaluation on
or before July 1, 2012. The board is required to report to certain committees of the
General Assembly on the implementation of recommendations made by the
Department of Legislative Services.
Senate Bill 458, which was passed by the General Assembly and signed by me,
accomplishes the same purpose. Therefore, it is not necessary for me to sign House
Bill 463.
