SUBTITLE 8. CRIMINAL PROCEDURE.
5-801. INVESTIGATION BY STATE POLICE.
NOTWITHSTANDING ANY OTHER LAW, THE DEPARTMENT OF STATE POLICE
MAY INITIATE INVESTIGATIONS AND ENFORCE THIS TITLE AND TITLE 12 OF THE
CRIMINAL PROCEDURE ARTICLE THROUGHOUT THE STATE WITHOUT REGARD TO
ANY LIMITATION OTHERWISE APPLICABLE TO THAT DEPARTMENT'S ACTIVITIES IN A
MUNICIPAL CORPORATION OR OTHER POLITICAL SUBDIVISION.
REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 298(e).
The reference allowing the Department of State Police to initiate
investigations and enforce "this title" is substituted for the former obsolete
reference to "the provisions of §§ 276 through 302 of this article" to apply to
all sections of this title, including those that were enacted after the
enactment of former Art. 27, § 298(e). When former § 298(e) was enacted by
Ch. 403 of the Laws of 1970, the former controlled dangerous substances
subheading included only §§ 276 through 302.
5-802. STATEWIDE JURISDICTION FOR OFFICERS.
(A) INVESTIGATIONS AND ENFORCEMENT.
(1) NOTWITHSTANDING ANY OTHER LAW, A LAW ENFORCEMENT
OFFICER OF THE MARYLAND TRANSPORTATION AUTHORITY POLICE, THE MARYLAND
PORT ADMINISTRATION POLICE, OR A MUNICIPAL CORPORATION OR COUNTY MAY
INVESTIGATE AND OTHERWISE ENFORCE THIS TITLE AND TITLE 12 OF THE
CRIMINAL PROCEDURE ARTICLE THROUGHOUT THE STATE WITHOUT ANY
LIMITATION AS TO JURISDICTION AND TO THE SAME EXTENT AS A LAW
ENFORCEMENT OFFICER OF THE DEPARTMENT OF STATE POLICE.
(2) THE AUTHORITY GRANTED IN PARAGRAPH (1) OF THIS SUBSECTION
MAY BE EXERCISED ONLY IN ACCORDANCE WITH REGULATIONS THAT THE
SECRETARY OF THE STATE POLICE ADOPTS.
(3) THE REGULATIONS ARE NOT SUBJECT TO TITLE 10, SUBTITLE 1 OF
THE STATE GOVERNMENT ARTICLE.
(B) REQUIRED NOTIFICATIONS.
