2002 LAWS OF MARYLAND
A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A FELONY AND ON
CONVICTION IS SUBJECT TO IMPRISONMENT NOT EXCEEDING 20 YEARS OR A FINE
NOT EXCEEDING $20,000 OR BOTH. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, §§ 286C and 286E. In subsection (a)(1)(i) of this section, the former reference to the use of a
minor "in any manner" is deleted as surplusage. In subsection (a)(2) of this section, the reference to a violation of "§ 5-602,
§ 5-603, § 5-604, § 5-605, § 5-606, § 5-612, [and] § 5-613" of this subtitle
is substituted for the former reference to "§ 286" of the former "Health -
Controlled Dangerous Substances" subheading of Article 27, although §§
5-607 through 5-609 of this subtitle are also derived from former § 286.
Because §§ 5-607 through § 5-609 contain only sentencing provisions and
not prohibited acts, they do not define "violations". No substantive change
is intended. Defined terms: "Controlled dangerous substance" § 5-101
"Deliver" § 5-101
"Distribute" § 5-101
"Manufacture" § 5-101
"Minor" § 1-101
"Person" § 1-101 GENERAL REVISOR'S NOTE TO SUBTITLE Former Art. 27, § 290, which limited the maximum punishments for attempting
or conspiring to violate the former "Controlled Dangerous Substances" subheading of
Article 27, is deleted as duplicative of the general limitations on punishment for
attempt and conspiracy. See General Revisor's Note to Title 1, Subtitle 2 of this

5-701. DISPENSING PRESCRIPTION DRUG.
(A) SCOPE OF SECTION. SECTIONS 5-701 THROUGH 5-704 OF THIS SUBTITLE APPLY TO: (1) THE SALE OF PRESCRIPTION DRUGS BY A MANUFACTURER,
WHOLESALE DISTRIBUTOR, RETAIL PHARMACIST, OR JOBBER TO A PERSON NOT
LEGALLY QUALIFIED OR AUTHORIZED TO PURCHASE AND HOLD PRESCRIPTION
DRUGS FOR USE OR RESALE; AND (2) AN AUTHORIZED PROVIDER'S ASSISTANT WHO IS NOT LICENSED TO
ADMINISTER PRESCRIPTION DRUGS.
