S.B. 376 VETOES
(5) On a form approved by the Commissioner, the surplus lines broker shall: (I) make a clear and conspicuous written disclosure of:
[(i)] 1. any inspection fee; [(ii)]2. the total amount of the policy fee; [and]
[(iii)] 3. the premium tax on the policy; AND 4. ANY FINANCIAL INTEREST IN THE PERSON PERFORMING
THE INSPECTION, IF APPLICABLE; AND 5. WHETHER THE SURPLUS LINES BROKER WILL RECEIVE
COMPENSATION FROM THE PERSON THAT PERFORMS THE INSPECTION: AND
(II) NOTIFY THE PROSPECTIVE INSURED OF THE OPTION TO
OBTAIN THE INSPECTION FROM ANOTHER PERSON WHO MEETS THE REQUIREMENTS
OF OR IS APPROVED BY THE SURPLUS LINES INSURER SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2002.

Annapolis MD 21401 Dear Mr. President: In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 376 - Baltimore City - Contract Disputes. This bill prohibits Baltimore City from raising the defense of sovereign immunity in
any contract action based on a written contract executed on behalf of the City. The bill
provides that Baltimore City is not liable for punitive damages in any such contract
action. It provides that a claim is barred unless the claimant files suit within the later
of one year from the date on which the claim arose or one year after completion of the
contract giving rise to the claim. The bill requires the Mayor and City Council of
Baltimore to make adequate funds available to cover any final judgment rendered
against Baltimore City. House Bill 452, which was passed by the General Assembly and signed by me,
accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
