(2) THE DEADLINE IN THIS SUBSECTION MAY BE EXTENDED BY
AGREEMENT OF THE PARTIES AND WITH THE CONCURRENCE OF THE
ADMINISTRATIVE LAW JUDGE.
(C) A DECISION UNDER SUBSECTION (A) OF THIS SECTION THAT DISMISSES
FEWER THAN ALL OF THE ISSUES IN AN ACTION, OR THAT ADJUDICATES ISSUES
CONCERNING FEWER THAN ALL OF THE PARTIES TO AN ACTION IS NOT
IMMEDIATELY APPEALABLE UNLESS THE ADMINISTRATIVE LAW JUDGE
DETERMINES THAT THERE IS NO JUST REASON FOR DELAY, AND DIRECTS THE ENTRY
OF A DECISION AS TO ONE OR MORE, BUT FEWER THAN ALL OF THE ISSUES OR
PARTIES.
(D) EXCEPT AS PROVIDED UNDER SUBSECTION (C) OF THIS SECTION, A
DECISION BY THE ADMINISTRATIVE LAW JUDGE ON A MOTION IN ACCORDANCE
WITH SUBSECTION (A) OF THIS SECTION IS A FINAL AGENCY DECISION AND SHALL
BE APPEALABLE IN THE SAME MANNER AS A FINAL DECISION BY THE DEPARTMENT
AFTER A CONTESTED CASE HEARING.
(E) THE DEADLINES IN THIS SECTION SHALL BE CONSIDERED MANDATORY
AND NOT DIRECTORY.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall apply to be
construed to apply prospectively and shall be applied to and interpreted to affect all
requests for contested case hearings under Title 1, Subtitle 6 of the Environment
Article made on or after July 1, 2002.
SECTION 3. 4. AND BE IT FURTHER ENACTED, That this Act shall take
effect October July 1, 2002.

AN ACT concerning
State Retirement and Pension System - Estimate of Pension Benefits
Teachers' Retirement System - Purchase of Service Credit - Refund
FOR the purpose of providing the Board of Trustees of the State Retirement and
Pension System with certain powers if the actual retirement benefit received by
a retiree is a certain percent lower than a certain estimate of benefits and the
retiree acted in reliance upon the estimate; providing for the application of this
Act; and generally relating to estimates of retirement benefits to retirees of the
State retirement and pension systems providing certain retirees with a refund of
certain assets used to purchase certain service credit plus interest at a certain
rate; requiring the Board of Trustees for the State. Retirement and Pension
System to make certain adjustments to the retirement allowance of certain
retirees; requiring the Board of Trustees for the State Retirement and Pension
