2002 LAWS OF MARYLAND
(2) IT CONTAINS ANY QUANTITY OF: (I) BARBITURIC ACID OR A SALT OF BARBITURIC ACID; OR (II) A DERIVATIVE OF BARBITURIC ACID THAT THE SECRETARY OF
HEALTH AND HUMAN SERVICES DESIGNATES AS HABIT FORMING UNDER § 502(D) OF
THE FEDERAL FOOD, DRUG, AND COSMETIC ACT (21 U.S.C. § 352(D)); (III) AMPHETAMINE OR ITS OPTICAL ISOMERS; (IV) A SALT OF AMPHETAMINE OR A SALT OF AN OPTICAL ISOMER
OF AMPHETAMINE; (V) A SUBSTANCE THAT THE ATTORNEY GENERAL OF THE UNITED
STATES DESIGNATES AS HABIT-FORMING BECAUSE OF ITS STIMULANT EFFECT ON
THE CENTRAL NERVOUS SYSTEM; OR (VI) A SUBSTANCE THAT THE ATTORNEY GENERAL OF THE UNITED
STATES DESIGNATES AS HAVING A POTENTIAL FOR ABUSE BECAUSE OF: 1. A DEPRESSANT OR STIMULANT EFFECT ON THE CENTRAL
NERVOUS SYSTEM; OR 2. A HALLUCINOGENIC EFFECT. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, §§ 277(j) and the introductory language to 279. In subsection (a) of this section, the former reference to "whatever" official
name is deleted as surplusage. Subsection (b) of this section is revised as a scope provision for Schedules I
through V, for clarity. In subsection (b)(2)(v) of this section, the former reference to the Attorney
General of the United States "after investigation, ha[ving] found to be, and
by regulation" designating as habit forming is deleted as included in the
reference to "designating]" the substance as a "depressant or stimulant
drug". Similarly, in subsection (b)(2)(vi) of this section, the former
reference to the Attorney General of the United States "after investigation,
ha[ving] found to have, and by regulation" designating as having a
potential for abuse is deleted as included in the reference to "designat[ing]"
the substance as a "depressant or stimulant drug". Defined terms: "Controlled dangerous substance" § 5-101
"Depressant or stimulant drug" § 5-101 5-402. SCHEDULE I. (A) IN GENERAL. SCHEDULE I CONSISTS OF EACH CONTROLLED DANGEROUS SUBSTANCE:
