2002 LAWS OF MARYLAND
(1) HAS MATERIALLY FALSIFIED AN APPLICATION FILED IN
ACCORDANCE WITH OR REQUIRED BY THIS TITLE; (2) HAS BEEN CONVICTED OF A CRIME UNDER FEDERAL LAW OR THE
LAW OF ANY STATE RELATING TO A CONTROLLED DANGEROUS SUBSTANCE; (3) HAS HAD FEDERAL REGISTRATION SUSPENDED OR REVOKED AND
MAY NO LONGER MANUFACTURE, DISTRIBUTE, OR DISPENSE A CONTROLLED
DANGEROUS SUBSTANCE; OR (4) HAS VIOLATED THIS TITLE. (B) LIMITS ON REVOCATION OR SUSPENSION. THE DEPARTMENT MAY LIMIT REVOCATION OR SUSPENSION OF A
REGISTRATION TO THE PARTICULAR CONTROLLED DANGEROUS SUBSTANCE FOR
WHICH GROUNDS FOR REVOCATION OR SUSPENSION EXIST. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 282(a), (b), and the reference to a denial of
registration and a refusal of renewal of registration in (c). In the introductory language of subsection (a) of this section, the former
reference to a registration "pursuant to § 281, as amended from time to
time" is deleted as implicit in the defined term "registration". Also in the introductory language of subsection (a) of this section, the
reference to the ability of the Department to "deny a registration to any
applicant ... or refuse to renew a registration" states explicitly the former
implicit reference to the ability of the Department "pursuant to a denial of
registration or to a refusal of renewal of registration under § 281". Also in the introductory language of subsection (a) of this section, the
former reference to a registration "to manufacture, distribute, or dispense"
is deleted as implicit in the reference to a "registration". In subsection (a)(2) of this section, the reference to a "crime" is substituted
for the former reference to an "offense" for consistency. See General
Revisor's Note to article. In subsection (a)(3) of this section, the former reference to registrant whose
federal registration has been suspended or revoked "by competent federal
authority and is no longer authorized by federal law to engage in the
manufacturing, distribution, or dispensing of controlled dangerous
substances" is deleted as implicit in the reference to having had "federal
registration suspended or revoked". Defined terms: "Controlled dangerous substance" § 5-101
