Ch. 440 2002 LAWS OF MARYLAND
SECTION 11. AND BE IT FURTHER ENACTED, That any balance remaining
in the Right-of-Way Revolving Fund on June 30, 2002 shall be credited to the
Transportation Trust Fund. SECTION 12. AND BE IT FURTHER ENACTED, That: (a) (1) In this section the following words have the meanings indicated. (2) "Attorneys fees litigation" means: (i) The case of State of Maryland, et al. v. Law Offices of Peter G.
Angelos, PC, Circuit Court of Baltimore City, No. 24-C-99-005702; and (ii) The appeals of the Law Offices of Peter G. Angelos, a
Professional Corporation, before the Maryland State Board of Contract Appeals,
MSBCA Nos. 2161 and 2168. (3) "Fund" means the Special Reserve Fund established under this section. (4) "Tobacco settlement moneys" means moneys received by the State
from any source resulting, directly or indirectly, from any judgment against or
settlement with tobacco product manufacturers, tobacco research associations, or any
other person in the tobacco industry relating to litigation, administrative proceedings,
or any other claims made or prosecuted by the State to recover damages for violations
of State law. (b) (1) A Special Reserve Fund is established to retain State revenues for
special needs as provided in this section. (2) The Fund is a continuing, nonlapsing fund which is not subject to §
7-302 of the State Finance and Procurement Article. (3) The Fund consists of the moneys distributed to the Fund under
subsection (c) of this section. (4) The Treasurer shall separately hold, and the Comptroller shall
account for, the Fund. (5) (i) The Fund shall be invested and reinvested in the same manner
as other State funds. (ii) Any investment earnings shall be credited to the Fund. (c) Notwithstanding § 7-317(b)(2) of the State Finance and Procurement
Article or any other provision of law, for each of fiscal years 2002 and 2003 only, there
shall be credited to the Fund any moneys received by the State during the fiscal year
from any of the following sources: (1) Payments made by tobacco manufacturers for the State's legal fees
and costs for outside counsel in the State's litigation against tobacco manufacturers,
as determined by an arbitration panel established under the Master Settlement
Agreement dated November 23, 1998, through which that litigation was settled, in
