transportation, and subsistence expenses of engineers assigned to the design and
preparation of contract plans and specifications, surveys, supervision of construction,
and inspection of construction work; (5) Administrative and legal services, including: accounting; supervision;
legal expenses; traveling, transportation, and subsistence expenses of personnel; and
other administrative expenses, including any parts of the general administrative
expenses of the Administration allocated or prorated to the project; and (6) Miscellaneous expenses, including: any other item of expense not
otherwise covered by this section. 8-305. [(a) There is a Right-of-Way Revolving Fund in the Transportation Trust
Fund. (b) (1) The Right-of-Way Revolving Fund may be used only to pay the costs
of acquiring property for: (i) Any future State highway system project that is scheduled for
construction or reconstruction within 5 years after the fiscal year in which the
expenditure is made for the acquisition; (ii) Any State highway system project that is an expressway or
controlled access highway and that is included in the Administration's 20-year needs
study and also in the Department's master plan of highways approved by a political
subdivision; and (iii) Any future Department of State Police post site related to a
project described in this subsection. (2) For purposes of this subsection, the costs of acquisition include: (i) The cost of preliminary and other engineering of the project; (ii) The consideration, including consequential damages, paid to
property owners in acquiring the property; and (iii) The cost of appraisals, legal services, court costs, recording fees,
and other related and necessary services incurred in acquiring the property. (c) (1) Except as otherwise provided in this subsection, the Administration
may spend not more than $5-million from the Right-of-Way Revolving Fund in any
fiscal year. (2) If the Administration spends less than $5-million from the Fund in
any one fiscal year, the balance may be spent in any other fiscal year for any purpose
permitted by this section. (d) (1) When a contract is awarded for any project for which property was
purchased from the Right-of-Way Revolving Fund, the Fund shall be reimbursed or
credited as provided in this subsection.
