Ch. 26 2002 LAWS OF MARYLAND
|
|
|
|
|
|
|
|
|
(III) A SENTENCE IMPOSED UNDER THIS PARAGRAPH SHALL BE
CONSECUTIVE TO AND NOT CONCURRENT WITH ANY OTHER SENTENCE IMPOSED
FOR THE FELONY OR CRIME OF VIOLENCE.
REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 36H-6.
In subsection (b) of this section, the references to "crime of violence" are
substituted for the former references to "misdemeanor" to state explicitly
that this provision only applies to misdemeanors that are crimes of
violence.
In subsection (b)(1) of this section, the former reference to a "separate"
misdemeanor is deleted as surplusage.
In subsection (b)(2)(i) and (3)(i) of this section, the former references to a
sentence to the "Maryland Division of Correction" are deleted for
consistency within this article. Currently, inmates are sentenced to the
custody of an agency such as the Division of Correction and then are placed
in a particular facility. See CS § 9-103.
In subsection (c)(3)(i) of this section, the reference to "each" subsequent
violation is substituted for the former reference to "a second or" subsequent
violation for consistency within this article.
Defined terms: "Assault pistol" § 4-301
"Person" § 1-101
SUBTITLE 4. UNIFORM MACHINE GUN ACT.
