(C) PENALTY. A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A MISDEMEANOR AND
ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT EXCEEDING 1 YEAR OR A FINE
NOT EXCEEDING $1,000 OR BOTH. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 36G(a)(1) through (5) and (7) and (b) and (c). In subsection (a)(2)(i) of this section, the reference to "attract[ing]" a crowd
or onlookers is substituted for the former reference to "draw[ing]" a crowd
or onlookers for clarity and for consistency with subsection (a)(2)(ii) of this
section. Also in subsection (a)(2)(i) of this section, the reference to holding a "vigil"
is substituted for the former reference to holding "vigils" in light of Art. 1,
§ 8, which provides that the singular includes the plural. In subsection (a)(3)(ii) of this section, the reference to "antique firearm" is
substituted for the former reference to "antique firearms" in light of Art. 1,
§ 8, which provides that the singular includes the plural. In subsection (a)(5)(i), (ii), and (iii) of this section, the former references to
a "duly appointed" member or officer are deleted as surplusage. In subsection (a)(5)(i) of this section, the reference to a "unit" is substituted
for the former reference to an "agency" for consistency within this article.
See General Revisor's Note to article. Also in subsection (a)(5)(i) of this section, the references to a "municipal
corporation" are substituted for the former references to a "municipality"
for consistency with the usage in Md. Constitution, Art. XI-E. In subsection (c) of this section, the reference to a fine "not exceeding"
$1,000 is added to state expressly that which formerly was only implied in
Art. 27, § 36G(c). Former Art. 27, § 36G(a)(6), which provided that the definitions of a "rifle",
"shotgun", "short-barreled rifle", and "short-barreled shotgun" of § 4-201
of this subtitle also apply to this section, is deleted as redundant of the
subtitle-wide definitions of the same terms in § 4-201 of this subtitle. Defined terms: "Antique firearm" § 4-201
