(B) PENALTY.
A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A MISDEMEANOR AND
ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT EXCEEDING 1 YEAR OR A FINE
NOT EXCEEDING $1,000 OR BOTH.
REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 36E(1).
In subsection (a) of this section, the reference to a permit issued or
renewed under "Article 27, § 36E of the Code" is added for clarity.
In subsection (b) of this section, the reference to a fine "not exceeding"
$1,000 is added to state expressly that which formerly was only implied in
Art. 27, § 36E(1).
Also in subsection (b) of this section, the reference to a person being
"subject to" imprisonment and a fine is substituted for the former
requirement that the person "be fined ... or be imprisoned" for consistency
within this article.
