(2) The terms of members are staggered as required by the terms
provided for members of the Commission on July 1, 1984;
(3) At the end of a term, a member continues to serve until a successor is
appointed and qualifies;
(4) A member who is appointed after a term is begun serves for the rest
of the term and until a successor is appointed and qualifies;
(5) A member may serve no more than 2 terms; and
(6) Any member of the Commission appointed by the Governor who shall
fail to attend at least 60% of the meetings of the Commission during any period of 12
consecutive months shall be considered to have resigned, and the chairman shall
forward the member's name to the Governor, not later than January 15 of the year
following the nonattendance with the statement of the nonattendance, and the
Governor shall appoint a successor for the remainder of the term. If the member has
been unable to attend meetings as required by this subtitle for reasons satisfactory to
the Governor, the Governor may waive the resignation if the reasons are made public.
(d) If a vacancy arises other than by the expiration of a term, the Governor
shall appoint within 30 days, with the advice and consent of the Senate, a successor of
like qualification to serve the remainder of the term.
(e) (1) A quorum of the Commission consists of 1 member more than a
majority of the full authorized membership of the Commission.
(2) A quorum of a panel of the Commission consists of 3 members.
(3) The Commission or a panel of the Commission may not hold a public
hearing unless a quorum is present.
(4) The Commission or a panel of the Commission may not take any
official action unless:
(i) A quorum is present; and
(ii) A majority of the members who are present and eligible to vote
concur in or vote for the action.

(A) The Commission has all powers necessary for carrying out the purposes of
this subtitle, including the following:
(1) To adopt regulations and criteria in accordance with Title 2, Subtitle
5 (Joint Committee on Administrative, Executive and Legislative Review) and Title
10, Subtitle 1 (Administrative Procedure Act) of the State Government Article;
(2) To conduct hearings in connection with policies, proposed programs,
and proposed regulations or amendments to regulations; [and]
(3) To contract for consultant or other services; AND
