(2) health maintenance organizations that provide hospital, medical, or
surgical benefits to individuals or groups under contracts that are issued or delivered
in the State. (c) (1) An entity subject to this section shall provide coverage of habilitative
services for children under the age of 19 years and may do so through a managed care
system. (2) (I) An entity subject to this section is not required to provide
reimbursement for habilitative services delivered through early intervention or school
services. (II) AN ENTITY SUBJECT TO THIS SECTION MAY NOT REQUIRE A
CHILD TO SEEK OR RECEIVE HABILITATIVE
SERVICES THROUGH EARLY
INTERVENTION OR
SCHOOL BASED SERVICES. (d) An entity subject to this section shall provide notice annually to its
insureds and enrollees about the coverage required under this section. (E) A DETERMINATION BY AN ENTITY SUBJECT TO THIS SECTION DENYING A
REQUEST FOR HABILITATIVE SERVICES OR DENYING PAYMENT FOR HABILITATIVE
SERVICES ON THE GROUNDS THAT A CONDITION OR DISEASE IS NOT A CONGENITAL
OR GENETIC BIRTH DEFECT IS CONSIDERED AN "ADVERSE DECISION" UNDER §
15-10A-01 OF THIS ARTICLE. SECTION 2. AND BE IT FURTHER ENACTED, That all policies, contracts,
and health benefit plans subject to the provisions of this Act shall make the benefits

under this Act available on and after its effective date, notwithstanding any
statement in the policy, contract, or health benefit plan to the contrary
this Act shall
apply to all policies, contracts, and health benefit plans issued, delivered, or renewed
in the State on or after October 1, 2002. SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2002. Approved May 6, 2002.
CHAPTER 383
(House Bill 697) AN ACT concerning Business Occupations and Professions - Certified Interior Designers' - Seal FOR the purpose of authorizing the State Board of Certified Interior Designers to
deny a certificate to any applicant, reprimand any certificate holder, or suspend
or revoke a certificate if the applicant or certificate holder signs or seals certain
documents under certain circumstances; requiring certified interior designers to
endorse certain interior design documents with a seal, signature, and the date;
