3-704. EXTORTION BY FALSE ACCUSATION.
(A) PROHIBITED.
A PERSON, WITH THE INTENT TO EXTORT MONEY OR PROCURE OTHER PROFIT,
MAY NOT FALSELY ACCUSE OR THREATEN TO ACCUSE ANOTHER OF A CRIME OR OF
ANYTHING THAT, IF THE ACCUSATION WERE TRUE, WOULD TEND TO BRING THE
OTHER INTO CONTEMPT OR DISREPUTE.
(B) PENALTY.
A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A MISDEMEANOR AND
ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT EXCEEDING 2 YEARS.
REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 563.
In subsection (b) of this section, the reference to a person "who violates this
section" is added for consistency with other penalty provisions in this
subtitle and throughout this article. Similarly, the phrase "is subject to"
imprisonment is substituted for the former phrase "punishable by"
imprisonment.
Also in subsection (b) of this section, the reference to a person "on
conviction" being subject to imprisonment is added to state expressly that
which was only implied in the former law, and for consistency with other
penalty provisions in this subtitle and throughout this article.
Also in subsection (b) of this section, the former reference to imprisonment
"in jail or the house of correction" is deleted for consistency within this
article. Currently, inmates are sentenced to the custody of a unit such as
the Division of Correction and then are placed in a particular facility. See
CS § 9-103.

3-705. EXTORTION BY VERBAL THREAT.
(A) PROHIBITED.
A PERSON, WITH THE INTENT TO EXTORT OR GAIN MONEY, PROPERTY, OR
ANYTHING OF VALUE FROM ANOTHER, MAY NOT VERBALLY THREATEN TO:
(1) ACCUSE ANY PERSON OF A CRIME THAT MAY BE CHARGED BY
INDICTMENT UNDER THE LAWS OF THE STATE OR OF ANYTHING THAT, IF TRUE,
WOULD BRING THE PERSON INTO CONTEMPT OR DISREPUTE; OR
(2) INJURE THE PERSON OR PROPERTY OF ANYONE.
