PERSONALLY LIABLE FOR REPAYING TO THE COMPTROLLER ANY PART OF A PUBLIC
CONTRIBUTION THAT IS NOT SPENT OR THAT WAS SPENT IN VIOLATION OF
SUBSECTION (A) OF THIS SECTION.
REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 33, § 15-106.
Throughout this section, the defined term "gubernatorial ticket" is
substituted for the former word "candidate". See the Revisor's Note to §
15-102(f) of this title.
In subsection (a)(1) of this section, the phrase providing that a public
contribution may be spent only "in accordance with § 13-218 of this article"
is substituted for the former phrase "[w]ith the authority of the candidate
or his treasurer" for clarity and consistency with other provisions of this
article. The Election Law Article Review Committee notes, for
consideration by the General Assembly, that the reference in former Art.
33, § 15-106(a)(1) to the authority of "the candidate or his treasurer" was
ambiguous. The Committee assumes that the General Assembly intended
that this provision be consistent with expenditure standards elsewhere in
this article.
In subsection (a)(3) of this section, the reference to "the public
contribution" is substituted for the former reference to "these" for clarity.
In subsection (c) of this section, the reference to the "members of a"
gubernatorial ticket is added for clarity and consistency with the purpose
of this subsection to impose joint and several liability on each candidate,
i.e., the members of the gubernatorial ticket, and the responsible officers,
for a violation of this title. See also the Revisor's Note to § 15-105 of this
title.

15-108. BALANCE IN FUND.
ANY BALANCE IN THE FUND AFTER A GUBERNATORIAL ELECTION SHALL
REMAIN IN THE FUND FOR THE PURPOSES OF THIS TITLE.

change from former Art. 33, § 15-108.
The reference to a balance after "disbursements to candidates in" a
gubernatorial election is deleted as surplusage.
