(II) DOES NOT APPLY TO EXPENDITURES MADE ON BEHALF OF A
GUBERNATORIAL TICKET BY A STATE OR LOCAL CENTRAL COMMITTEE. (B) CERTIFICATION OF LIMIT. THE STATE BOARD SHALL CERTIFY THE EXPENDITURE LIMIT FOR EACH
ELECTION IN ACCORDANCE WITH SUBSECTION (A)(1) OF THIS SECTION. (C) DETERMINATION OF POPULATION. THE POPULATION OF THE STATE SHALL BE DETERMINED BY THE STATE BOARD
AS OF JANUARY 1 OF THE YEAR OF THE ELECTION IN ACCORDANCE WITH THE MORE
RECENT OF: (1) THE MOST RECENT DECENNIAL CENSUS OF THE UNITED STATES; OR (2) ANY POPULATION ESTIMATE PREPARED FOR THE STATE BY THE
DEPARTMENT OF HEALTH AND MENTAL HYGIENE. (D) LIABILITY FOR VIOLATIONS. THE MEMBERS OF THE GUBERNATORIAL TICKET AND, IF ASSOCIATED WITH
THE EXPENDITURE, THE RESPONSIBLE OFFICERS OF ITS CAMPAIGN FINANCE
"ENTITY ARE JOINTLY AND SEVERALLY LIABLE CIVILLY AND CRIMINALLY FOR AN
EXPENDITURE MADE IN VIOLATION OF THIS SECTION. REVISOR'S NOTE: Subsections (a)(1) and (2)(ii), (c), and (d) of this section are
new language derived without substantive change from former Art. 33, §
15-103. Subsection (a)(2)(i) of this section is new language added for clarity and
accuracy. Subsection (b) of this section is new language added for clarity and for
consistency with other provisions of this title. In subsections (a) and (d) of this section, the defined term "gubernatorial
ticket" is substituted for the former word "candidate". See the Revisor's
Note to § 15-102(f) of this title. In subsection (a)(1) of this section, the reference to accepting a contribution
from the Fund "for an election" is added for clarity and accuracy. Also in subsection (a)(1) of this section, the former reference to a
"gubernatorial ticket" that "applies for" a public contribution is deleted as
implicit. A ticket may not accept money from the Fund unless the ticket
first notifies the State Board of its intent to qualify for a public
contribution and then submits a formal request for a public contribution.
See § 15-109(b)(2) of this title. In subsection (c) of this section, the former phrase "[f]or purposes of this
section" is deleted as surplusage. Also in subsection (c) of this section, the reference to the determination of
