BEING USED AS A MEANS OF TRANSPORTATION ON WATER OR ICE.
(2) "VESSEL" DOES NOT INCLUDE A SEAPLANE.

2-102. ELIMINATION OF YEAR AND A DAY RULE.
A PROSECUTION MAY BE INSTITUTED FOR MURDER, MANSLAUGHTER, OR
UNLAWFUL HOMICIDE, WHETHER AT COMMON LAW OR UNDER THIS TITLE,
REGARDLESS OF THE TIME THAT HAS ELAPSED BETWEEN THE ACT OR OMISSION
THAT CAUSED THE DEATH OF THE VICTIM AND THE VICTIM'S DEATH.
REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 415.
The reference to "this title" is substituted for the former reference to
"Article 27, §§ 407 through 411, § 387, § 388, or § 388A" to reflect the
reorganization of the former statutory provisions on murder,
manslaughter, and the several types of homicide by vehicle or vessel in this
title.
The reference to "unlawful homicide" is added to reflect the application of
this section to the various types of homicide by motor vehicle or vessel
under Subtitle 5 of this title, all derived from former Art. 27, § 388A.
This section applies only prospectively and may not be applied to any crime
committed before October 1, 1996. See § 3, Ch. 360, Acts of 1996.
SUBTITLE 2. MURDER AND MANSLAUGHTER
2-201. MURDER IN THE FIRST DEGREE.
(A) IN GENERAL.
A MURDER IS IN THE FIRST DEGREE IF IT IS:
(1) A DELIBERATE, PREMEDITATED, AND WILLFUL KILLING;
(2) COMMITTED BY LYING IN WAIT;
(3) COMMITTED BY POISON; OR
(4) COMMITTED IN THE PERPETRATION OF OR AN ATTEMPT TO
PERPETRATE:
(I) ARSON IN THE FIRST DEGREE;
(II) BURNING A BARN, STABLE, TOBACCO HOUSE, WAREHOUSE, OR
OTHER OUTBUILDING THAT:
1. IS NOT PARCEL TO A DWELLING; AND
