(3) The annual renewal fee for certification as a producer of organic
commodities is $100.
(b) The annual permit fee for a processor of organic commodities is $100.
(c) The annual permit fee for a distributor or retailer of organic commodities
is $75.
(d) Permits and certifications under this subtitle expire 1 year from the date
of issuance.
(e) The Secretary shall establish procedures for the issuance of permits and
certifications under this subtitle.] THE SECRETARY SHALL SET A REASONABLE FEES
FOR THE CERTIFICATION OF PRODUCERS AND HANDLERS TO PARTIALLY DEFRAY
THE COST OF OPERATING THE ORGANIC CERTIFICATION PROGRAM FEE, NOT TO
EXCEED $500, TO DEFRAY THE COST OF CONDUCTING FIELD INSPECTIONS AND
LABORATORY ANALYSIS AS REQUIRED BY THE UNITED STATES DEPARTMENT OF
AGRICULTURE'S ORGANIC FOOD PROGRAM FOR ACCREDITED CERTIFYING AGENTS.

EXCEPT AS PROVIDED BY REGULATIONS ADOPTED BY THE UNITED STATES
DEPARTMENT OF AGRICULTURE PURSUANT TO THE FEDERAL ORGANIC FOOD
PRODUCTION ACT, 7 U.S.C. § 6501 ET SEQ., THE RECORD CUSTODIAN SHALL DENY
ACCESS TO ANY BUSINESS-RELATED INFORMATION CONCERNING ANY PERSON
REGULATED UNDER THIS SUBTITLE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 2002.
