(d) (1) Except as provided in § 8-1207 of this title for the work sharing
program and § 8-1604 of this title for the Self-Employment Assistance Program, an
eligible claimant shall be paid a weekly benefit amount that is computed by:
(i) determining the claimant's weekly benefit amount under this section; (ii) adding any allowance for a dependent to which the claimant is
entitled under § 8-804 of this subtitle; and
(iii) subtracting any wages exceeding [$70] $90 payable to the
claimant for the week.
(2) In computing benefits under this subsection, a fraction of a dollar
shall be rounded to the next lower dollar.
SECTION 2. AND BE IT FURTHER ENACTED, That if the Department of
Labor, Licensing, and Regulation determines that on September 30, 2002, the ratio
between the Unemployment Insurance Trust Fund balance and the total taxable
wages for the four completed calendar quarters immediately preceding September 30, 2002, is less than 4.7%, the provisions of this Act shall be null and void without the
necessity of further action by the General Assembly, If the Department of Labor,
Licensing, and Regulation determines that on September 30, 2002, the ratio between
the Unemployment Insurance Trust Fund balance and the total taxable wages for the
four completed calendar quarters immediately preceding September 30, 2002, is less
than 4.7%, the Department shall notify the Department of Legislative Services, 90
State Circle, Annapolis, Maryland, within 15 days of that determination. SECTION 2. 3. AND BE IT FURTHER ENACTED, That, subject to Section 2
of this Act, this Act shall take effect July 1, 2002 January 1, 2003 and shall apply to
all claims filed establishing a new benefit year on or after July 1, 2002 January 5, 2003. Approved April 25, 2002.
