(e) A person who knowingly makes a false statement under oath on an
application filed with the Commissioner under this section is guilty of perjury and[,
upon] ON conviction[,] is subject to the penalties [set forth in Article 27, § 439 of the
Code] OF § 9-101 OF THE CRIMINAL LAW ARTICLE.
Article - Health - General
7-1005.
(a) (1) In this section, "abuse" means:
(iii) Any of the following kinds of sexual abuse:
1. A sexual act, as defined in [Article 27, § 461(e) of the
Code] § 3-301 OF THE CRIMINAL LAW ARTICLE;
2. Sexual contact, as defined in [Article 27, § 461(f) of the
Code] § 3-301 OF THE CRIMINAL LAW ARTICLE; or
3. Vaginal intercourse, as defined in [Article 27, § 461(g) of
the Code) § 3-301 OF THE CRIMINAL LAW ARTICLE.

(a) (1) In this section, "abuse" means cruel or inhumane treatment that
causes:
(ii) Any of the following kinds of sexual abuse:
1. A sexual act, as defined in [Article 27, § 461(e) of the
Code] § 3-301 OF THE CRIMINAL LAW ARTICLE.
2. Sexual contact, as defined in [Article 27, § 461(f) of the
Code) § 3-301 OF THE CRIMINAL LAW ARTICLE.
3. Vaginal intercourse, as defined in [Article 27, § 461(g) of
the Code] § 3-301 OF THE CRIMINAL LAW ARTICLE.
15-123.
(a) (3) "Fraud" includes the commission of or an attempt or conspiracy to
commit the crimes of:
(I) [concealment] CONCEALMENT of medical [records, violation
under the Fraud - State Health Plans subheading of Article 27 of the Code, false]
RECORDS;
(II) VIOLATION OF TITLE 8, SUBTITLE 5, PART II OF THE CRIMINAL
LAW ARTICLE;
(III) FALSE representations relating to Medicaid health [plans,
misappropriation] PLANS;
(IV) MISAPPROPRIATION by a [fiduciary,] FIDUCIARY; and [theft]
