(d) The Department may use Program funds to:
(1) Acquire real property interests in the green infrastructure network

(b) (2) If at the time of testing an individual has an alcohol concentration
that meets the [under the influence of alcohol per se] definition OF "UNDER THE
INFLUENCE OF ALCOHOL PER SE" in § 11-127.1 of the Transportation Article, as
determined by an analysis of the individual's blood or breath, it shall be prima facie
evidence that the individual was operating a vessel while under the influence of
alcohol.

Every final decision, order, or regulation of the Commission is prima facie
correct and shall be affirmed unless clearly shown to be:
(1) unconstitutional;
(2) outside the statutory authority or jurisdiction of the Commission;
(3) made on unlawful procedure;
(4) arbitrary or capricious;
(5) affected by other error of law; or
(6) if the subject of review is an order entered in a contested proceeding
after a hearing, [the order is] unsupported by substantial evidence on the record
considered as a whole.
