SECTION 10. 14. AND BE IT FURTHER ENACTED, That the Board of the
Maryland Health Insurance Plan shall begin enrolling individuals in the Plan and in
the Senior Prescription Drug Program no later than July 1, 2003.
SECTION 11. 15. AND BE IT FURTHER ENACTED, That Sections 1 through
4, 2, 3, 5, and 6 of this Act shall take effect July 1, 2003.
SECTION 16. AND BE IT FURTHER ENACTED, That Section 4 of this Act
shall take effect January 1, 2003.
SECTION 12. 17. AND BE IT FURTHER ENACTED, That, except as provided
in Section 11 Sections 15 and 16 of this Act, this Act shall take effect July 1, 2002.

(House Bill 1254)
AN ACT concerning
Acquisition of a Nonprofit Health Service Plan - Prohibition Entity -
Determination by Regulating Entity
FOR the purpose of prohibiting a nonprofit health service plan formed or organized
under the laws of the State from forming or organizing under the laws of another
jurisdiction unless the Insurance Commissioner makes a certain determination;
prohibiting a nonprofit health service plan from altering its structure,
operations, or affiliations under certain circumstances; providing that the
Insurance Commissioner may revoke a certificate of authority issued to a foreign
corporation under certain circumstances; prohibiting officers and directors of a
nonprofit health service plan from receiving certain remuneration as the result of
a certain acquisition, subject to a certain exception; providing that a certain
acquisition is not in the public interest unless appropriate steps have been taken
to ensure that no officer, director, or trustee receives certain remuneration from
the acquisition, subject to a certain exception; requiring that a certain
determination may not take effect until a certain time; requiring a certain
regulating entity to determine if certain assets distributed to a certain public or
nonprofit charitable entity must be in the form of cash; requiring that certain
assets distributed to a certain public or nonprofit charitable entity be in the form
of cash; requiring a certain regulating entity to determine whether a certain
payment required under a certain contract is in the public interest; prohibiting a
nonprofit health service plan from being subject to acquisition; prohibiting a
person from engaging in the acquisition of a nonprofit health service plan;
repealing certain provisions of law relating to the acquisition of a nonprofit
health service plan; altering certain definitions; defining a certain term; and
generally relating to prohibiting the acquisition of a nonprofit health-service
plan providing for a stay of a certain determination of a certain regulating entity
for a certain period of time; specifying that the General Assembly reserves the
