(Senate Bill 331) AN ACT concerning Assisted Living Programs - Implementation of Regulations Concerning
Survey and Complaint Reporting FOR the purpose of requiring the Secretary of Health and Mental Hygiene to adopt
regulations requiring that certain reports documents or a certain notice
concerning assisted living programs be conspicuously posted in a public place
accessible to residents of
the assisted living program facility posted in a
conspicuous place visible to certain persons. BY repealing and reenacting, with amendments,

Section 19-1805(c)(2)
Annotated Code of Maryland (2000 Replacement Volume and 2001 Supplement) SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows: Article - Health - General 19-1805. (c) (2) The regulations adopted under paragraph (1) of this subsection shall: (i) Provide for the licensing of assisted living programs and the
renewal of licenses; (ii) Require the Secretary to charge fees in a manner that will
produce funds not to exceed the actual direct and indirect costs to the Department for
inspecting assisted living program facilities and maintaining the licensure program
for assisted living programs under this subtitle; [and] (iii) Require the Department, during a survey or other inspection of
an assisted living program, to review the number of waivers granted to the program
under subsection (a)(3) of this section and determine whether a change in the
program's licensure status is warranted; AND (III) REQUIRE THAT AN ASSISTED LIVING PROGRAM FACILITY'S
STATEMENT OF DEFICIENCIE
S FOR THE MOST RECENT SURVEY AND ANY
SUBSEQUENT COMPLAINT INVESTIGATIONS CONDUCTED BY FEDERAL, STATE, OR
LOCAL
SURVEYORS AND ANY PLANS OF CORRECTION IN EFFECT WITH RESPECT TO
THE
SURVEY OR COMPLAINT INVESTIGATION FINDINGS BE POSTED CONSPICUOUSLY
IN A PUBLIC PLACE ACCESSIBLE TO ACTUAL OR POTENTIAL RESIDENTS
AND
INTERESTED PERSONS OF THE ASSISTED LIVING PROGRAM FACILITY.
