Ch. 135
Subtitle 6. Electric [and Transportation] Cooperatives. [5-601. (a) Cooperative, nonprofit, membership corporations may be organized to
supply, promote, and extend the use of electric energy. (b) Each cooperative organized under this section shall be organized under
and governed by Ch. 179, Acts of 1976, the "Electric Cooperative Act".] PART I. DEFINITIONS; GENERAL PROVISIONS.
5-601. DEFINITIONS. (A) IN GENERAL. IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS INDICATED. DRAFTER'S NOTE: This subsection is new language substituted as the
standard introductory language to a definition section for the introductory language
of former Ch. 179, § 3, Acts of 1976, as amended by Ch. 604, Acts of 2001. (B) COOPERATIVE. "COOPERATIVE" MEANS A CORPORATION THAT: (1) IS ORGANIZED UNDER THIS SUBTITLE; OR (2) BECOMES SUBJECT TO THIS SUBTITLE IN THE MANNER PROVIDED
IN THIS SUBTITLE. DRAFTER'S NOTE: This subsection is new language derived without
substantive change from former Ch. 179, § 3(b), Acts of 1976, as amended by Ch. 604,
Acts of 2001. (C) ELECTRIC PLANT. "ELECTRIC PLANT" MEANS THE MATERIAL, EQUIPMENT, AND PROPERTY
OWNED BY A COOPERATIVE AND USED OR TO BE USED FOR OR IN CONNECTION WITH
ELECTRIC SERVICE. DRAFTER'S NOTE: This subsection is new language added for brevity and
consistency with terminology used in the Public Utility Companies Article. Defined term: "Cooperative" § 5-601 (D) MEMBER "MEMBER" MEANS A PERSON OR HOUSEHOLD THAT HAS BEEN QUALIFIED AND
ACCEPTED FOR MEMBERSHIP IN A COOPERATIVE IN ACCORDANCE WITH ITS
BYLAWS.
