In subsection (b) of this section and throughout this section, the former
references to a "boat" are deleted as included in the defined term "vessel". Also in subsection (b) of this section, the former reference to "us[ing]" a
vessel is deleted as included in the reference to "operat[ing]" a vessel. In subsection (c) of this section, the former reference to imprisonment "in
the Maryland House of Correction" is deleted for consistency with the
Criminal Law Article. Currently, inmates are sentenced to the custody of a
unit such as the Division of Correction, and then are placed in a particular
facility. See CS § 9-103. Also in subsection (c) of this section, the former reference to "the discretion
of the court" is deleted as implicit in setting minimum and maximum
penalties. In subsection (d) of this section, the reference to a court "order[ing]"
forfeiture is substituted for the former reference to a court "declar[ing]"
forfeiture for accuracy and consistency. Defined terms: "Department" § 8-101

"Waters of the State" § 8-101 8-724.1. DAMAGING OR INTERFERING WITH USE OF PUBLIC WHARF OR LANDING. (A) PROHIBITED. A PERSON MAY NOT: (1) INTERFERE WITH THE USE OF A PUBLIC LANDING; (2) DO ANYTHING TO DESTROY THE USEFULNESS OF THE PUBLIC
LANDING; OR (3) DAMAGE A WHARF OR STRUCTURE ERECTED ON THE WHARF BY THE
STATE, A COUNTY, OR A PERSON UNDER A WRITTEN AGREEMENT WITH A STATE UNIT
OR A COUNTY FOR PUBLIC BENEFIT. (B) PENALTY. A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A MISDEMEANOR AND
ON CONVICTION IS SUBJECT TO A FINE OF NOT LESS THAN $25. REVISOR'S NOTE: Chapter 26, Acts of 2002, which enacted the Criminal Law
Article, also added this section, which is new language derived without
substantive change from former Art. 27, § 484. As to the substitution of the reference to a "State unit" for the former
reference to "State authority" in subsection (a) of this section, see General
Revisor's Note to the Criminal Law Article.
