In subsection (a) of this section, the reference to an amount and price "of
the goods sold" is added for clarity.
Also in subsection (a) of this section, the former references to after a sale
"shall have been made by him" and goods consigned "to him" are deleted as
surplusage.
In subsection (b) of this section, the reference to the additional penalty of
"court costs" is substituted for the former reference to the additional
penalty of "together with the cost of prosecution" for consistency with Title
7 of the Courts and Judicial Proceedings Article.
Also in subsection (b) of this section, the reference to each "violation" is
substituted for the former reference to each "and every offense" for
consistency with the Criminal Law Article. See General Revisor's Note to
the Criminal Law Article.

14-1316. DEBT ADJUSTING.
(A) "DEBT ADJUSTING" DEFINED.
IN THIS SECTION, "DEBT ADJUSTING" MEANS THE MAKING OF A CONTRACT,
EXPRESSED OR IMPLIED, WITH A DEBTOR AND ANOTHER PERSON ENGAGED IN THE
DEBT ADJUSTING BUSINESS BY WHICH THE DEBTOR AGREES TO PAY A CERTAIN
AMOUNT OF MONEY PERIODICALLY TO THE OTHER, WHO FOR CONSIDERATION
DISTRIBUTES THE MONEY AMONG SPECIFIED CREDITORS IN ACCORDANCE WITH AN
AGREED PLAN.
(B) PROHIBITED.
A PERSON MAY NOT ENGAGE IN THE BUSINESS OF DEBT ADJUSTING.
(C) PENALTY.
A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A MISDEMEANOR AND
ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT EXCEEDING 6 MONTHS OR A
FINE NOT EXCEEDING $500 OR BOTH.
(D) EXCEPTIONS.
THIS SECTION DOES NOT APPLY TO THE FOLLOWING WHEN ENGAGED IN THE
REGULAR COURSE OF THEIR RESPECTIVE BUSINESSES AND PROFESSIONS:
(1) A LAWYER;
