PARRIS N. GLENDENING, Governor Ch. 26
slaughterhouse" is deleted as implicit in the reference to an "official
establishment". Also in subsection (b) of this section, the former reference to an official
establishment "subject to the provisions of this subtitle" is deleted as
surplusage. In subsection (c) of this section, the reference to "limit[ing]" freedom is
substituted for the former references to "abridg[ing] or in any way
hinder[ing]" freedom for brevity and clarity. Also in subsection (c) of this section, the reference to a "group" is deleted as
implicit in the reference to a "person", in light of Art. 1, § 8, which provides
that the singular generally includes the plural. In subsection (d) of this section, the reference to a "slaughterer, packer, or
stockyard operator" is substituted for the former reference to an "official
establishment or custom slaughterhouse" for clarity and accuracy. Also in subsection (d) of this section, the phrase "unless by a humane
method" is substituted for the former phrase "except by a humane method"
for clarity. In subsection (e) of this section, the former reference to a "custom
slaughterhouse" is deleted as implicit in the reference to an "official
establishment". In subsection (f)(1) of this section, the reference to "each violation" is
substituted for the former reference to "each such conviction" for clarity. Also in subsection (f)(1) of this section, the former reference to the
provisions of Art. 27, § 63 - now CR § 10-609 - which authorizes an officer
of a humane organization to make an arrest for cruelty to an animal, being
incorporated by reference and made applicable to the enforcement and
administration of this section is deleted as unnecessary because CR §
10-609 is implicitly applicable to the enforcement of this revised section. Also in subsection (f)(1) of this section, the former reference to a "firm or
corporation" that violates this subtitle is deleted in light of § 1-101(f) of
this article, which defines "person" to include a firm or a municipal or
private corporation. Also in subsection (f)(1) of this section, the former reference to "any
provision of this subtitle" is deleted as surplusage. Former Art. 27, § 333A(b), which defined "person", is deleted as
unnecessary because the same term is defined in § 1-101 of this article. Defined terms: "Person" § 1-101
"Poultry" § 1-101
"Secretary" § 1-101
