IF THE PURCHASER FAILS TO RETURN THE CONTAINER TO THE CONSIGNEE
WITHIN 5 DAYS, THE PURCHASER FORFEITS THE RIGHT TO THE RETURN OF THE
DEPOSIT AND THE CONSIGNEE SHALL PAY THE DEPOSIT TO THE OWNER OF THE
CONTAINER AT THE NEXT SETTLEMENT OF ACCOUNTS. REVISOR'S NOTE: Chapter 26, Acts of 2002, which enacted the Criminal Law
Article, also enacted this section, which is new language derived without
substantive change from the first sentence and the second sentence of
former Art. 27, § 170, as it related to container deposit. In subsection (a) of this section, the reference to "hold[ing]" a farm product
is substituted for the former reference to "pack[ing]" a farm product for
accuracy. Defined term: "Consignee" § 1-301
1-303. RETURNED CONTAINER. (A) DELIVERY TO CARRIER IF THE PURCHASER RETURNS THE CONTAINER TO THE CONSIGNEE: (1) THE CONSIGNEE SHALL DELIVER THE CONTAINER WITHIN 48 HOURS
TO THE CARRIER THAT DELIVERED THE CONTAINER TO THE PLACE OF SALE; AND (2) THE CONSIGNEE SHALL OBTAIN A RECEIPT FOR THE CONTAINER
FROM THE CARRIER. (B) RESPONSIBILITY AFTER DELIVERY. AFTER THE CONSIGNEE DELIVERS THE CONTAINER TO THE CARRIER: (1) THE CONSIGNEE SHALL HAVE NO FURTHER RESPONSIBILITY FOR
THE CONTAINER; AND (2) THE CARRIER SHALL BE RESPONSIBLE TO THE OWNER FOR THE
FULL VALUE OF THE CONTAINER UNTIL IT HAS BEEN RETURNED TO THE POINT AT
WHICH IT WAS RECEIVED FROM THE OWNER REVISOR'S NOTE: Chapter 26, Acts of 2002, which enacted the Criminal Law
Article, also enacted this section, which is new language derived without
substantive change from the second sentence of former Art. 27, §§ 170, as
it related to returned containers, and 171, as it related to the time limit for
returning a container. Defined terms: "Carrier" § 1-301
